Content of the Legal Notice

Acceptance of Legal Notice

This Legal Notice regulates the use of the services that Innoega makes available to users of the Internet through the Website.

The access and use of the Website by the user (hereinafter, the “User”) implies that the User accepts in its entirety and agrees to comply fully with the terms and conditions set forth in these Terms of Use, as well as in the Portal’s Privacy Policy. Click here if you wish to access the aforementioned Privacy Policy. Therefore, the User must read these Terms of Use carefully each time he/she intends to use the Portal, since the Portal and its conditions of use may undergo modifications.

Additionally, through the Portal, INNOEGA offers the User, among others, the following services:

  • Information about the different services offered by Innoega;
  • Innoega Periodicals
  • Event information
  • Information about careers at Innoega.

The use of the aforementioned services may be subject to specific conditions or instructions which must be accepted by the User and which, as indicated in each specific case, replace, complete and/or modify these Terms of Use.

Portal Terms of Use

Access to the Website is free of charge, except for the cost of connection through the telecommunications network provided by the access provider contracted by the User. The services provided by Innoega have the price indicated in the corresponding proposal of services and, in any case, are provided through the Website.

The User undertakes not to use the Website for fraudulent purposes and not to engage in any conduct that may damage the image, interests and rights of Innoega or third parties. The User also undertakes not to carry out any action aimed at damaging, invalidating or overloading the Website, or hindering in any way its normal use and operation.

The User is informed that in the event that he/she breaches the content of these Terms of Use, the Privacy Policy or any other particular terms or conditions contained in the Website, Innoega reserves the right to limit, suspend or terminate his/her access to the Website, adopting any technical measure necessary for that purpose. Innoega also reserves the right to exercise such measures in the event that it reasonably suspects that the User is violating any of the terms and conditions contained in the aforementioned instruments.

We inform the User that Innoega reserves the right, at any time, to decide on the continuity of the services provided through the Portal.

Finally, we inform the User that Innoega reserves the right to limit the User’s access to certain areas of the Portal (professional areas), being necessary for the User, in these cases, to register by providing the required data, and to choose an identifier and a password that he/she must keep and use diligently.

Intellectual and Industrial Property

The intellectual property rights on the layout of the contents of the Website (sui generis right on the database), its graphic design (look & feel), the underlying computer programs (including source codes), as well as the various elements that make up the Website -text, graphics, photographs, videos, sound recordings, etc.- (hereinafter, the “Content”), belong to Innoega or its licensors. With respect to the distinctive signs included in the Portal (trademarks and trade names) they are the property of Innoega or its licensors.

The use of the Website by the User does not imply the transfer of any intellectual and/or industrial property rights over the Website, the Content and/or the distinctive signs of Innoega. For this purpose, by means of these Terms of Use, except in those cases where it is legally permitted or with prior authorization from Innoega, the User is expressly forbidden to reproduce, transform, distribute, publicly communicate, make available, extract and/or reuse the Portal, its Contents and/or the distinctive signs of Innoega.

Links Policy

Establishment of links to the Portal

The establishment of links to the Website is prohibited, unless previously authorized in writing by Innoega. In any case, once the link has been authorized by Innoega, it must be established in the following terms:

  • The link will only link to the home page or main page of the Portal.
  • The link may not consist of frames or frames that allow the visualization of the Portal through Internet addresses other than those of the Website or that in any other way show together the information of the Portal with that included in other web pages.
  • The website that introduces the link (hereinafter, the “Linking Site”) shall not make any false, inaccurate or incorrect statement about the Portal and/or Innoega.
  • In no case does the authorization granted by Innoega mean that: (i) it sponsors, collaborates, verifies or supervises the content and/or services provided through the Linking Site; nor (ii) that it is responsible for the content of the Linking Site.
  • The Linking Site must faithfully comply with the Law and may not in any case host content, whether its own or third parties’, that: (i) are unlawful, harmful or contrary to morals and good customs (pornographic, violent, racist, etc.); (ii) induce or may induce in the User the false conception that Innoega subscribes to, endorses, supports, adheres to or in any way supports the ideas, manifestations or expressions, lawful or unlawful, of Innoega.); (ii) induce or may induce in the User the false conception that Innoega subscribes, endorses, adheres or in any way supports the ideas, statements or expressions, lawful or unlawful of the sender; and (iii) are inappropriate or irrelevant in relation to the activity of Innoega.

In the event of non-compliance with any of the aforementioned terms, INNOEGA shall immediately and without prior notice remove the link.

Linked Sites

In order to help you find additional information, we have included various technical linking devices that allow the User to access other websites (hereinafter, the “Linked Sites”). In these cases, Innoega acts as an intermediary service provider, according to the provisions of Article 17 of the LSSI. In accordance with the provisions of the aforementioned legislation, Innoega will not be responsible for the services and contents provided through the Linked Sites, unless it has actual knowledge of the unlawfulness and has not disabled the link with due diligence.
In no case the existence of Linked Sites implies recommendation, promotion, identification or conformity of Innoega with the statements, contents or services provided through the Linked Sites. Consequently, Innoega is not responsible for the content of the Linked Sites, nor for their conditions of use and privacy policies, being the User the only responsible for checking and accepting them every time he/she accesses and uses them.

Reporting of activities of an illegal and inappropriate nature

In the event that the User or any other Internet user becomes aware that any kind of information or content of the Portal or provided through it is unlawful, harmful to the rights of third parties, contrary to the provisions of these Terms of Use or otherwise harmful or contrary to morals, customs and customs, you can contact Innoega through the following email address [email protected] indicating the following points:

  • Personal data of the caller: name, address, telephone number and e-mail address.
  • Description of the facts that reveal the illicit or inadequate nature of the content or information as well as the specific address where it is available.
    – In the event of infringement of third party rights, such as intellectual and industrial property, the data of the holder of the infringed right must be provided when it is a person other than the communicating party. It must also provide the title that proves the ownership of the infringed rights and, where appropriate, the representation to act on behalf of the owner when it is a person other than the communicator.

The receipt by Innoega of the communication provided for in this clause does not imply, according to the provisions of the LSSI, the actual knowledge of the activities and / or contents indicated by the caller, when it is not obvious or evident. In any case, Innoega reserves the right to suspend or remove the contents that, although not illegal, are contrary to the rules set out in these Terms of Use, weighing in each case the legal assets in conflict.

INNOEGA’s Responsibility

The User must know that communications through open networks are exposed to a plurality of threats that make them unsafe. It is the User’s responsibility to adopt all appropriate technical measures to reasonably control these threats and, among them, to have updated systems for detecting malicious software, such as viruses, Trojans, etc., as well as to have updated security patches for the corresponding browsers. For more information you can contact your Internet Access Service Provider who will be able to provide you with the appropriate solutions for your needs. Innoega is not responsible for damages caused to the User as a result of risks inherent to the medium used, or those caused by vulnerabilities in their systems and tools. Innoega does not guarantee the total security of its systems and although it has adopted adequate security measures, the existence of vulnerabilities cannot be completely ruled out and, therefore, the User must be cautious when interacting with the Website. Innoega shall only be liable for damages caused by the use of the Website, when such damages are directly caused by intent or gross negligence of Innoega and there was no negligence on the part of the User.
In particular, Innoega will not be responsible, in any case, for:

  • Damages of any kind caused to the User’s computer equipment by viruses, worms, Trojans or any other harmful element.
  • The damages of any kind caused to the User due to failures or disconnections in telecommunications networks that cause the suspension, cancellation or interruption of the Portal service during the provision of the same. In this regard, the User acknowledges that access to the Website requires services provided by third parties outside the control of Innoega (for example: telecommunications network operators, access providers, etc.) whose reliability, quality, continuity and operation does not correspond to Innoega, nor is part of its responsibility to ensure the availability of the service.
  • Indirect, unforeseen, special or incidental damages, including loss of profits, income or data, suffered by either party or by a third party.
  • Of the information of third parties in cases in which it acts as a provider of intermediation services in the sense given by the LSSI, except when there is effective knowledge and the corresponding information has not been withdrawn.

The information provided by Innoega through the Website does not constitute a professional opinion or any advisory service, being the sole purpose of the Website to provide Users with general information obtained from public data without Innoega assuming any responsibility for the veracity, accuracy and timeliness of such data. Innoega is not responsible for the decisions taken based on the information provided on the Website, since the contents of the Website are of a general nature and do not constitute the provision of a consulting service of any kind, so that such information is insufficient for professional or business decisions by the User.

Data protection

As indicated in the “Acceptance of the Legal Notice” section of these Terms of Use, the aspects relating to the processing of Users’ personal data when using the Portal are regulated in the Privacy Policy, as well as in the legal texts attached to the various data collection forms included in the Portal.

Miscellaneous

In the event that any of the provisions contained in this Legal Notice is declared null and void, it will be withdrawn or replaced. In any case, such declaration of invalidity shall not affect the validity of the remaining provisions contained in these Terms of Use.
